The nationally consistent legislative scheme for gene technology is comprised of the Commonwealth
Gene Technology Act 2000 and
Gene Technology Regulations 2001, and corresponding State and Territory legislation. The Tasmanian component of the scheme is the
Gene Technology Act 2012.
The
Gene Technology (Tasmania) Act 2012 operates to the extent that it does not conflict with the existing moratorium in Tasmania on commercial release of GMOs for marketing purposes, given effect under the
Genetically Modified Organisms Control Act 2004.The Gene Technology (Tasmania) Act 2012 replaced the Gene Technology Act 2001 following a review and public consultation process in 2007.
