Conservation covenants may be established to meet environmental offset or compliance requirements where impacts cannot be fully avoided.
What is an offset covenant?
An offset covenant is a conservation covenant established:
These covenants are registered on title and supported by a Nature Conservation Plan.
When offset covenants are used
Offset covenants may support compliance under Tasmanian or Australian Government legislation, including the Environment Protection and Biodiversity Conservation Act 1999.
They do not automatically satisfy offset requirements.
Offset requirements are determined by the relevant approving authority on a case‑by‑case basis.
Roles and responsibilities
Landowners: manage the land under covenant
Proponents: may fund establishment or management
Regulators: set offset conditions and oversee compliance
PLCP: assesses, registers and administers covenants
