The Threatened Species Protection Regulations, made under the Threatened Species Protection Act 1995 are due to be remade by 17 August 2026. This legislative instrument regulates the protection of threatened species in Tasmania.

How to have your say
All submissions on the draft Threatened Species Protection Regulations 2026 must be received by 5pm on 12 June 2026.
At the conclusion of this public consultation period submissions will be published on the Departments website (unless a preference is stated otherwise). Private information will be omitted. All consultation will be considered.
Any amendments that arise from the consultation will be proposed for inclusion in the Final Draft Regulations.

Why have the Threatened Species Protection Regulations been remade?
The Subordinate Legislation Act 1992 requires regulations to be remade every ten years. The Threatened Species Regulations were last made on 17 August 2016 and therefore must be remade by the same date this year.
What has changed from the 2016 Regulations?
Very little is proposed to be changed in the updated draft Regulations. The remake has focussed on:
The Listed Taxon Permit categories reflected in the draft Regulations are reflective of the permits received by stakeholders already. There are no additional burdens placed on stakeholders nor has the protection of threatened species been reduced.
Why has the list of definitions from the 2016 Regulations reduced in the draft Regulations?
Words that are defined in the Threatened Species Protection Act 1995, which is the parent Act to the Regulations, do not need to be re-defined in the Regulations.
Why are the details for what should be included in a Permit Application now missing from the draft Regulations?
Under section 41 the Threatened Species Protection Act 1995 stipulates the applications must be in writing. This section also requires the application form to be approved by the Secretary. As a result, there is no need to further stipulate application requirements in the Regulations.
Has the Nomination Form in Schedule 1 been amended?
No, the Nomination Form was last amended in December 2024. It is reproduced in the 2026 Regulations as it currently appears in the existing Regulations.
