Mortgagees

​​​​Please note: any capitalised term has the meaning given to it in the Recorder’s Directions, the Participation Rules, the Operating Requirements, or the Electronic Conveyancing National Law (ECNL) as applicable.

Mortgagees​

A Mortgagee who is Self-represented can prepare and sign* a Registry Instrument or other Document.

A Mortgagee can choose to be represented by a Licensed Conveyancer or Legal Practitioner (acting as Representative*).

For the purposes of electronic conveyancing, a mortgagor, or potential mortgagor, is not a Client of the mortgagee. Therefore, the mortgagee cannot prepare Registry Instruments or other Documents on behalf of a mortgagor or potential mortgagor. The mortgagee can however prepare and sign Registry Instruments or other Documents on its own behalf or retain a Licenced Conveyancer or Legal Practitioner to prepare and sign Registry Instruments or other Documents on its behalf. 

Cancellation of Approvals to Print​

​The introduction of national electronic conveyancing through the licensing of Property Exchange Australia Ltd (PEXA) to operate in Tasmania, combined with the availability of the Tasmanian On-Line Land Dealings (TOLD) system, removes the need for approval to print “paper forms”.​

The form types that have been approved for printing in the past are now available via PEXA or the TOLD system. Web services are also available for use by clients operating in-house systems. 

Approvals to Print are cancelled as of 31 December 2025​.

​A transition period will apply to cancellations of approvals to print to allow for implementation of the change. Approval to Print forms will be accepted for lodgment if executed and lodged prior to or on 13 February 2026.

​​Can a bank prepare a change of name?

No, a bank cannot prepare a change of name. A mortgagor or potential mortgagor is not a Client and therefore a mortgagee cannot act on their behalf. The mortgagor or potential mortgagor is a customer or potential customer of the bank.

Can a bank lodge a change of name?

For paper-based conveyancing:
Yes, a bank can lodge a change of name but when doing so must also lodge the ​Lodgement Form – Contact Details​

​​I am a self-represented mortgagee. Do I need a Client Authorisation from the mortgagor?

No, the mortgagee is not representing the mortgagor when preparing a mortgage or discharge of mortgage (the mortgagor is not the mortgagee's Client). The mortgagee is acting on its own behalf (self-represented).
