SUBJECT: TRANSFEROR ADDRESSES – 2022 REGULATIONS​

​​As noted in Office Circular 12/2022 and officially published in the Gazette, the new Land Titles Regulations 2022 came into effect on 28 November 2022.

An exposure draft of the new Regulations was publicly circulated at the start of November to provide the lodging public with the opportunity to ask questions regarding Land Titles Office practices prior to their coming into effect. 

Notwithstanding this, since the new Regulations came into effect, the Land Titles Office has received a large number of enquiries regarding new regulation 13(1)(i), particularly as to whether the Transferor’s address is required on Transfers.

Until further notice and in exercise of the new discretion under regulation 13(4), the policy of the Land Titles Office is that:

  • The address of the Transferor is not required on Transfer (T) forms
  • The address of the Mortgagor is not required on Discharge of Mortgage (DM) or Partial Discharge forms 

As a consequence, T, DM and Partial Discharge forms without the Transferor or Mortgagor’s addresses respectively will not be requisitioned. 

By contrast, the address of the Transferee is required on T forms, and the address of the Mortgagee is required on DM and Partial Discharge forms.
