SUBJECT: PROPERTY CONVEYANCING REFORMS – INFORMATION SESSIONS
In the new year, the Recorder of Titles will formally publish a set of Directions specifying requirements and procedures regarding preparation and lodgement of documents, in accordance with Section 160A(6) of the Land Titles Act 1980. The Recorder will advise of the date that these Directions will come into effect.
The Directions will introduce many of the requirements which also form part of the National Electronic Conveyancing System, which is planned to be introduced in Tasmania in the coming months.
The planned changes will have a significant impact on practices and procedures related to property conveyancing, and conveyancing practitioners should begin preparing for these changes.
The Directions will introduce requirements related to Verification of Identity, Verification of Authority to participate in a conveyancing transaction (Right to Deal), Client Authorisation and changes to witnessing requirements for certain dealings, Certifications, retention of evidence and Compliance Examination, and future removal of certificates of title from the lodgement process.
The Land Titles Office will circulate shortly a draft of the Directions so that practitioners can familiarise themselves with the new requirements. Further, the Land Titles Office will soon be publishing relevant educational material.
To assist with the transition to the new practices and procedures associated with conveyancing, the Land Titles Office will be conducting Information Sessions at the following dates, times and venues:
- Launceston Information Session
Date: Tuesday, 6 February 2024
Venue: Hotel Grand Chancellor Launceston, 29 Cameron Street, Launceston TAS 7250
Time: 3:30 pm to 5 pm. Registration and coffee/tea session will commence at 3 pm
- Devonport Information Session
Date: Wednesday, 7 February 2024
Venue: Gateway Hotel, 16 Fenton Street, Devonport TAS 7310
Time: 11:30 am to 1 pm. Registration and coffee/tea session will commence at 11 am
- Hobart Information Session
Date: Thursday, 8 February 2024
Venue: RACV Hobart Hotel, 154-156 Collins Street, Hobart TAS 7000
Time: 3:30 pm to 5 pm. Registration and coffee/tea session will commence at 3 pm
