SUBJECT: TASMANIAN PARTCIPATION RULES AND TASMANIAN OPERATING REQUIREMENTS FOR ELECTRONIC CONVEYANCING

Prior to the introduction of electronic conveyancing, Tasmania is required to issue participation rules and operating requirements to facilitate the introduction of electronic conveyancing in Tasmania.

The participation rules regulate the use by Subscribers of an Electronic Lodgment Network to participate in electronic conveyancing.  

The operating requirements regulate the operation of an Electronic Lodgment Network by Electronic Lodgment Network Operators.

The rules and requirements contained in the Model Participation Rules and Model Operating Requirements, published by the Australian Registrars' National Electronic Conveyancing Council (ARNECC), have been made as Tasmania's rules and requirements. When new versions of the Model Participation Rules and Model Operating Requirements are published, new versions of Tasmania's rules and requirements will then be made.

Two statutory rules, the Electronic Conveyancing National Law (Tasmanian Participation Rules) Rules 2023 and Electronic Conveyancing National Law (Tasmanian Operating Requirements) Rules 2023, came into effect on 6 December 2023. These statutory rules enable the making of Tasmania's rules and requirements for electronic conveyancing.

In accordance with the statutory rules referenced, the Tasmanian Participation Rules and Operating Requirements take effect 20 business days after being published by the Registrar, and therefore take effect 8 March 2024.

The Tasmanian Participation Rules and Operating Requirements only relate to electronic conveyancing and are being published now to ensure both Subscribers and Electronic Lodgment Network Operators can prepare prior to the introduction of electronic conveyancing in Tasmania.
