SUBJECT: INTRODUCTION OF PRIORITY FINAL PLAN SCHEME

On Monday, 30 November 2020 the Priority Final Plan (PFP) scheme will come into effect replacing the current Early Issue scheme. The PFP scheme will be replacing the Early Issue scheme following amendments to division 3 of the Local Government (Building and Miscellaneous Provisions) Act 1993.  The PFP scheme has been introduced to ensure more expeditious land release and development by sealed plan in the State of Tasmania via legislated timeframes for the plan examination and title registration.  Timeframes under the PFP scheme align the Land Titles Office (LTO) with those currently in place across other areas of the land development process.

What has changed?

From 30 November 2020 documents that are compliant with the PFP scheme, and do not require amendment via requisition, must have titles issued within 15 business days of the LTO receiving the Final Plan sealed by council. To improve the process lodging parties now have the option of lodging copies in the LTO initially, with original documents and the Certificate of Title or production slip now required at or before the time that the Final Plan sealed by council is the received by the LTO.

Lodgments under the Early Issue scheme will no longer be accepted by the LTO after 29 November 2020.

What hasn't changed?

Fees for documents lodged under PFP will remain the same as the fees that were payable under the Early Issue scheme.

How to comply with the Priority Final Plan scheme

Requirements for lodgment under the PFP scheme are set out in division 3 of the Local Government (Building and Miscellaneous Provisions) Act 1993. This section requires lodging parties to provide:

On initial lodgement:

  • The correct fees
  • A copy of the Final Plan marked “Priority Final Plan"
  • Confirmation lodgement has occurred within 5 business days of the Final Plan being lodged with council
  • Copies, or originals of:
    • Survey Notes
    • Schedule of Easements
    • Balance Plan (if required)

On or before receipt of Final Plan sealed by Council the following that have not already been lodged:

  • Certificate of Title or valid production slip
  • Survey Notes
  • Schedule of Easements
  • Balance Plan (if required)

 

If the correct fees, or any of the documents set out above are not provided, or, the original documents are not identical to the copies lodged with the LTO then the lodgment will not enjoy the benefits of the PFP scheme set out in division 3 of the Local Government (Building and Miscellaneous Provisions) Act 1993.

What happens to compliant Early Issue plans presently with the LTO?

All endeavours will be made to ensure that these lodgments are examined with utmost importance.
