SUBJECT: NATIONAL MORTGAGE FORM
FULL DISCHARGE OF MORTGAGE
Two issues have been raised with me for clarification. The first is the requirement to provide details of prior registered mortgages on the National Mortgage Form. The second is the requirement to lodge the original mortgage when lodging a full discharge of mortgage.
- In relation to the National Mortgage Form the details of prior registered mortgages do not need to be provided.
- In relation to a full discharge of mortgage the original mortgage form does not need to be lodged.
The practice of lodging a partial discharge of mortgage in place if a full discharge of mortgage must cease. Any use of this practice will be met with a refusal to register.
If you have a requisition which only relates to either one or both of the two issues raised above, please return it to the Land Titles Office and no requisition fee will apply.
The above takes effect as of Friday 1 March 2019.
