DISTRIBUTION: GENERAL
SUBJECT: Transfers by way of Assent
The Recorder of Titles has been advised by the Commissioner of State Revenue that the current exception from the requirement for Transfers by Way of Assent to be endorsed (i.e. stamped) will be revoked from 1 July 2017.
From 1 July 2017, Tasmania will move to full compliance with the Commonwealth's requirement to report extra data for all transfers of land in Tasmania to the ATO.
Reporting will also apply to Transfers by way of Assent (which will continue to be exempt from duty). However, to meet the reporting requirements, the current exception from the requirement for such transfers to be endorsed (i.e. stamped) will be revoked from 1 July 2017. Transfers by way of Assent can only continue to be lodged with the Land Titles Office, without being endorsed, up to and including 30 June 2017.
From 1 July 2017, Transfers by way of Assent can be self-endorsed as are other transfer types by using the upgraded Tasmanian Revenue Online (TRO). If you wish to register to use TRO, please contact the SRO by emailing revenuereview@treasury.tas.gov.au.
When endorsing a Transfer by way of Assent extra information will be required about the transferor (the personal representative) and the transferee to be entered into TRO. For more information please visit www.sro.tas.gov.au, or email revenuereview@treasury.tas.gov.au.
