NATIONAL MORTGAGE FORM
Land Registries across Australia have collaborated to develop a National Mortgage Form for implementation in all States and Territories. The National Mortgage Form standardizes the content and presentation of mortgages lodged for registration through all lodgment channels throughout Australia.
The Land Titles Office began accepting the lodgment of National Mortgage Forms from 1 July 2017.
The Australian Registrars' National Electronic Conveyancing Council (ARNECC) has produced a webform of the National Mortgage Form which can be completed and saved or completed and printed. ARNECC has also published the National Mortgage Form specifications on its website
www.arnecc.gov.au.
The National Mortgage Form will soon be available on the Tasmanian Online Land Dealings (TOLD) system for completion and lodgment in paper form.
APPLICATION TO CHANGE NAME ON MARRIAGE
As evidence to accompany the application the Land Titles Office will now accept certified copies of the ceremonial marriage certificate.
POWERS OF ATTORNEY BY A COMPANY
The execution of a power of attorney by a company is to be in accordance with section 127(1) of the
Corporations Act 2001. A further independent witness is not required.
LAND TITLES OFFICE DEALINGS
Dealings lodged with the Land Titles Office that are in any way distorted including partially incomplete words or numbering and not easily able to be scanned will either be refused or requisitioned for a fresh dealing.
TRANSFERS UNDER POWER OF SALE
In respect of a transfer on the exercise of a power of sale by a mortgagee or encumbrancee under section 78 of the
Land Titles Act 1980 the mortgage or encumbrance does not need to be produced.
