SUBJECT: FEE EXEMPTIONS - FAMILY LAW ACT 1975 (C'WEALTH) AND RELATIONSHIPS ACT 2003


The Land Titles Amendment Act 2005 has been passed by Parliament and has commenced.

The Amendment Act introduces a legislative basis for office practice regarding exemptions from fees provided for dealings lodged with the Land Data Registration Branch for the purposes of or in accordance with section 90 and Part VIIIA of the Family Law Act 1975 (C'wealth).

The Amendment Act also extends the provision of exemption from fees to dealings lodged with the Land Data Registration Branch for the purposes of or in accordance with an order made under the Relationships Act 2003, or a prescribed agreement. That is, dealings under the Relationships Act 2003, which were not previously exempted from fees, now have a legislative basis for exemption.
