SUBJECT: PRESCRIBED FEES UNDER LAND TITLES ACT 1980
Currently documents are being lodged with the Recorder of Titles accompanied by cheques that are not the prescribed fee as provided by the Land Titles Act 1980 (the Act) and are either underpayments or overpayments.
The Land Titles Regulations 2002 regulate the manner in which documents may be lodged with the Recorder of Titles. Regulations 16(1)(b) provides that an application or dealing presented for lodgement must be accompanied by the fee prescribed under the Act. Regulation 17(1)(a) further provides that the Recorder may refuse to accept an application or dealing for lodgement that does not comply in all respects with the requirements of the Act.
Accordingly, applications and dealings lodged with a cheque for over or under the prescribed fee will result in the cheque being returned and the processing of the application or dealing delayed until the cheque for the prescribed fee is lodged.
