Draft Strata Titles Amendment Bill 2026 Consultation

Have your say on the draft Strata Titles Amendment Bill 2026.

The draft Strata Titles Amendment Bill 2026 is open for public consultation from 11 September 2026 until 25 October 2026. The draft Strata Titles Amendment Bill 2026 is intended to amend the Strata Titles Act 1998.

What is happening?

The Strata Titles Act 1998 (the Act) was introduced in 1998 and provides a framework for the development of land by way of strata titles, including staged development schemes and community development schemes, and the regulation of day-to-day living and administration of strata developments. Strata living and strata developments in Tasmania have changed significantly since the Act was introduced and the current legislative framework is now no longer suitable.

A review of the Act in 2020 recommended some changes to improve the regulatory framework and to accommodate future strata title developments of different sizes, uses and configuration.

The Strata Titles Amendment Bill progresses some amendments in response to the review to support an evolving strata title environment.

What is proposed?

The proposed amendments focus on modernising the regulatory framework for day-to-day living and administration of strata developments.

The draft Bill addresses a range of issues including:

  • regulation of different types of strata title developments

  • improvements to strata plan requirements

  • identification of common property

  • information management by bodies corporate, for example: access to body corporate information and records

  • maintenance plan requirements

  • the introduction of disclosure and management statements

  • dispute resolution processes for strata disputes

  • enforcement of body corporate by-laws and

  • meeting procedures to suit modern practices.

An Information Paper accompanying the draft Bill outlines the proposed amendments and their purpose.

The Information Paper also provides details of proposed regulations intended to be introduced following proclamation of the Bill. Two sets of regulations are proposed: the first will be of general application, and the second will apply only to smaller developments (equal to or less than four (4) strata lot strata schemes).

Further sets of regulations applying to specific classes or types of strata schemes will be considered after these amendments are made to the Act.
